These Terms & Conditions ("Terms") govern your use of this website and your participation in programmes offered by Modari, a frugal living and smart spending education provider based in Johor Bahru, Malaysia. By accessing this website or enrolling in a programme, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use this website or enrol.

1. Definitions
- "Modari" / "we" / "us" / "our" — Modari, Level 7, Komtar JBCC, Jalan Wong Ah Fook, 80000 Johor Bahru, Johor, Malaysia.
- "You" / "User" / "Participant" — any person who visits this website or enrolls in a programme.
- "Programme" / "Service" — any workshop, course, or structured learning session offered by Modari, including the Smart Spending Workshop, Resourceful Living Programme, and Frugal Living Foundations Course.
- "Materials" — worksheets, workbooks, journals, toolkits, guides, and any content provided as part of a Programme.
- "Website" — this website at https://modaris.cyou and all pages within it.
- "Agreement" — these Terms, together with any enrolment confirmation or supplementary terms communicated at the time of registration.
2. Acceptance of Terms
By submitting an enquiry form, completing an enrolment, or attending a Programme, you agree to be bound by these Terms. You confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into this Agreement
- The information you provide during enrolment is accurate and complete
If you are registering on behalf of another person, you warrant that you have authority to agree to these Terms on their behalf.
3. Service Description
Modari offers structured, in-person frugal living and smart spending education programmes in Johor Bahru. Current programme offerings include:
- Smart Spending Workshop — half-day (4-hour) group session (RM 460)
- Resourceful Living Programme — five weekly group sessions (RM 1,460)
- Frugal Living Foundations Course — ten weekly group sessions (RM 3,650)
Programmes are delivered at our Johor Bahru premises unless otherwise communicated. Session dates, times, and venue details are confirmed upon enrolment. We reserve the right to adjust session dates with reasonable notice.
4. Enrolment
- Enrolment is confirmed only upon receipt of full payment and a written confirmation from Modari
- Places in each cohort are limited; enrolment is on a first-paid basis
- You are responsible for attending sessions on the dates confirmed at enrolment
- You must not share your enrolment place with another person without prior written consent from Modari
5. Participant Responsibilities
As a participant, you agree to:
- Treat fellow participants, facilitators, and Modari staff with courtesy and respect
- Not record, photograph, or livestream sessions without explicit written consent
- Not reproduce or distribute programme Materials without written permission from Modari
- Keep other participants' personal disclosures made during sessions confidential
- Arrive on time and participate in a constructive manner
Modari reserves the right to remove a participant from a session if their conduct is disruptive or disrespectful, without refund.
6. Intellectual Property
All content on this website and all programme Materials — including worksheets, workbooks, toolkits, guides, session outlines, and methodology — are the intellectual property of Modari. Upon enrolment and payment, you are granted a limited, non-exclusive, non-transferable licence to use the Materials for your own personal learning only.
- You may not copy, reproduce, distribute, or sell any Materials in whole or in part
- You may not use Modari's name, logo, or programme names in any commercial or promotional context without written permission
- Website content may not be scraped, republished, or used for AI training without permission
7. Payment & Refund Policy
Payment
- All fees are quoted and payable in Malaysian Ringgit (RM)
- Full payment is required to confirm enrolment
- Accepted payment methods are communicated at the time of enrolment
- Receipt of payment is confirmation of your place; a written confirmation will be sent within 2 working days
Cancellations & Refunds
- More than 14 days before the first session: full refund, less a RM 50 administrative fee
- 7–14 days before the first session: 50% refund
- Less than 7 days before the first session: no refund; a transfer to a future cohort may be arranged at Modari's discretion
- No-shows: no refund and no transfer
- If Modari cancels a session, participants will receive a full refund or the option to transfer to a future date
8. Programme-Specific Terms
- Missing a session does not entitle you to a partial refund or catch-up session, though Modari may offer supplementary notes at its discretion
- Modari does not issue formal academic certificates; participants receive a letter of completion upon finishing a programme
- Programme content is for general education only and does not constitute personalised financial, legal, or investment advice
- Session content may be updated between cohorts to keep examples relevant to current Malaysian market conditions
- Group sizes are managed to maintain session quality; Modari reserves the right to limit enrolment numbers
9. Disclaimers
- This website and its content are provided on an "as available" basis without warranties of any kind
- Modari does not warrant that the website will be uninterrupted, error-free, or free from viruses
- Programme content is general financial education; individual financial outcomes will vary and cannot be predicted or promised
- Nothing in any Modari programme constitutes advice regulated under the Capital Markets and Services Act 2007 or any other Malaysian financial services legislation
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Modari's total liability to you for any claim arising out of or in connection with these Terms or any Programme shall not exceed the fees paid by you for that specific Programme.
Modari is not liable for:
- Indirect, consequential, or incidental loss of any kind
- Loss of income, savings, or financial opportunity
- Circumstances beyond our reasonable control (force majeure), including natural disasters, pandemics, power outages, or government-ordered closures
11. Indemnification
You agree to indemnify and hold Modari, its staff, and facilitators harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your conduct during a session, or your misuse of programme Materials.
12. Termination
- Modari may terminate or suspend your enrolment if you breach these Terms
- You may withdraw from a programme subject to the refund policy in Section 7
- On termination, your licence to use programme Materials ceases; however, Materials already physically received are yours to keep for personal use
- Sections 5, 6, 9, 10, 11, and 13 survive termination of this Agreement
13. Dispute Resolution & Governing Law
These Terms are governed by the laws of Malaysia. In the event of a dispute, both parties agree to first attempt resolution through good-faith discussion. If unresolved within 30 days, the matter will be referred to mediation before any legal proceedings are initiated.
The courts of Johor Bahru, Malaysia shall have non-exclusive jurisdiction over any dispute that proceeds to litigation.
14. General Provisions
- Entire agreement: These Terms, together with any enrolment confirmation, form the complete agreement between us in relation to a Programme.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- No waiver: Modari's failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights or obligations under these Terms without written consent. Modari may assign its rights in connection with a business transfer.
- Notices: Formal notices should be sent to [email protected] or by post to our registered address.
15. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect the most recent revision. For material changes affecting existing enrolments, we will provide reasonable notice by email. Continued use of this website or participation in a Programme after changes take effect constitutes your acceptance of the revised Terms.
